Rudy Giuliani: By Jim Comey’s own description, Hillary is guilty of a federal crime



Rudy Giuliani used to be James Comey’s Boss at the Justice Department. 
That makes him an extremely credible source of criticism for the injustice done by James Comey.  

As reported by Hot Air Via the Free Beacon, he’s making the same point here that Andy McCarthy made in an NRO piece this morning. In order to believe that Hillary committed no crime, you have to rewrite 18 U.S.C. 793(f):
(f) Whoever, being entrusted with or having lawful possession or control of any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, note, or information, relating to the national defense, (1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed, or (2) having knowledge that the same has been illegally removed from its proper place of custody or delivered to anyone in violation of its trust, or lost, or stolen, abstracted, or destroyed, and fails to make prompt report of such loss, theft, abstraction, or destruction to his superior officer— Shall be fined under this title or imprisoned not more than ten years, or both.

You don’t need to intentionally mishandle classified information to be guilty. Gross negligence in your handling of it is enough. And here’s the important part: Comey himself signaled, quite overtly, that he believes Hillary was grossly negligent. If you tried to come up with another way of saying “gross negligence,” you could scarcely do better than “extremely careless,” the term Comey used this morning.

  1. there is no "intent" clause in the statute, so Comey's inventing one to let Hillary skate free makes him an accomplice after the fact.

  2. Add to that her real intention of doing what she did. I heard it cost her $160,000 to set up her home brewed server. Who does that unless they have a motive for doing it. End of case.
